Terms and Conditions of Sale
Thank you for shopping with Bayside Electric Supply. Upon process of your order, you agree to accept these terms and conditions of sale. Bayside Electric Supply Company, Inc. and Bayside Electric Supply of Southport, Inc. (both here within referred to as “Bayside Electric Supply”, “seller”, “our”, “us”, or “we”) reserve the right to modify or change the terms and conditions of sale at any time without prior notice to you.
FREE SHIPPING on most online orders over $99 that ship via small parcel UPS or FedEx Ground to the lower 48 states. Large parcel items that ship via motor freight carriers will be subject to a minimum of $65 per item in additional shipping charges. Expedited shipping requests will also be subject to additional shipping and handling charges. Shipping charges incurred due to incorrect address, zip code, or the refusal of an item will be charged back to the customer. We can only ship items to the lower 48 United States. We cannot ship C.O.D. or to any PO Box locations. Online orders less than $99 will incur a non-refundable standard processing and handling charge of $15. Prices shown or quoted do not include any shipping or handling charges.
All sales are subject to sales tax, unless a valid certificate of exemption is presented at the time the order is placed. No refunds will be issued for sales tax after the order is processed. Any taxes assessed or due shall be the buyer’s responsibility. Prices shown or quoted do not include any sales tax.
LOWEST PRICES ONLINE GUARANTEED, if you see the exact same lighting fixture or ceiling fan with a lower advertised price on another authorized dealer’s website prior to your purchase we may be able to meet or beat the price. The item must be the same finish and option with the exact same manufacturer part number. The item must be in stock and available for immediate shipment. The price must be published online and include shipping, handling, and tax. We must be able to verify the price with the competing dealer. Just email us prior to your purchase at lighting@BaysideSupply.com a link to the competitor’s website showing their lower advertised price and we will let you know what we can offer. Some manufactures have pricing policies that dealers must adhere to in order to maintain their status as a dealer for certain products. As a responsible dealer, we will not violate these policies and therefore will not match prices which are below the prices set forth in these policies. Our online price guarantee only applies to products listed on our website and does not apply to light bulbs, electrical supplies, wire, conduit, commercial lighting fixtures, central vacuum systems, audio systems, bath exhaust fans, generators, tools, batteries, parts, discontinued items, clearance items, on sale items, open-box items, used items, pricing errors, special offers, promotions, rebates, mail-in offers, free-with-purchase offers, limited quantity offers, bundled promotions, special financing, custom quoted items, volume discounts, bulk pricing, wholesale pricing, large purchases over $2000.00 or purchases of more than 6 of the same item. Guarantee only applies to manufacturer authorized dealers with retail locations in the United States. We reserve the right not to sell items below our cost. All promotional coupons, discounts, or offers must be submitted at the time the order is placed. No price adjustments will be made after the order is processed. Most local in-store confidential price quotations made by Bayside Electric Supply are valid for 30 days, except for wire and conduit which are subject to change daily without prior notice to you. Prices shown or quoted do not include any light bulbs, down rods, or accessories of any kind unless specifically indicated.
MONEY BACK GUARANTEE, if you are not completely satisfied with your product, you may return most items within (30) days of your purchase for a full refund, less shipping and handling charges, if the items are in stock at Bayside Electric Supply’s local warehouse and a Return Goods Authorization (RGA) is obtained. For special ordered items not stocked in our warehouse, the manufacturer’s return policies and restocking fees of at least 25% or more will apply. All return requests must be made within (10) days of receiving your order by notifying us at lighting@BaysideSupply.com. Products returned without a valid RGA will be refused from the shipper and no refunds or replacements will be issued. Once we issue a RGA, we must receive the product back within (10) days and it must be returned and shipped at the customer’s expense. Upon return of the product, all items must be in the original unmarked package, new condition, undamaged, and never installed or modified in any way. Approved refunds will be issued via the same method in which the item was purchased, except local in-store cash sales over $25 in which case a refund check will be mailed. No returns will be accepted after (30) days from purchase (no exceptions).
Non-refundable items include, but are not limited to, custom made-to-order items, light bulbs, lamp shades, batteries, parts, mirrors, furniture, cut wire, cut conduit, discontinued items, clearance items, on sale items, open-box items, used items, special offers, promotions, rebates, mail-in offers, free-with-purchase offers, limited quantity offers, bundled promotions, custom quoted items, volume discounts, bulk pricing, large purchases over $2000.00 or purchases of more than 6 of the same item. No refunds will be issued for any shipping charges or handling fees. Merchandise that has been damaged in the return transit are nonrefundable by Bayside Electric Supply, but may be refundable from your shipping carrier if the items are insured and a written claim has been made by you to the shipping carrier immediately. We recommend that you purchase insurance for your return shipments. Bayside Electric Supply will not issue a refund or replacement if your product is returned damaged from the carrier. In such a case, you must file a claim with the shipping company and advise us as what to do with the damaged product. We will hold your product for (30) days, after which the product will be destroyed.
Return of Damaged Products
Please inspect all items upon receipt, it is your responsibility to inspect the item immediately and before having it installed. If the packaging appears to be damaged on the outside, please make sure when signing the shipper’s proof-of-delivery slip that you include a detailed note stating the package appears to be damaged then notify the carrier and us immediately at lighting@BaysideSupply.com. Don’t ship the product back without a Return Goods Authorization (RGA) issued from Bayside Electric Supply with return instructions. If there is no notification from the customer after (10) days of receiving their order, a replacement or refund will not be issued (no exceptions).
Return of Defective Products
If within (10) days of receiving your order, any product proves to be defective, notify us immediately at lighting@BaysideSupply.com. Don’t ship the product back without a Return Goods Authorization (RGA) issued from Bayside Electric Supply with return instructions. After we receive the defective merchandise, upon claim and approval of inspection, a replacement will be ordered at no charge in exchange for the defective item, unless the item is discontinued or no longer available, then a refund of the purchase price less shipping and handling charges will be issued.
All products sold by Bayside Electric Supply and subsidiaries are only covered by the manufacturer’s transferable warranties. A copy of the manufacturer’s warranties will be furnished upon written request from the customer. BAYSIDE ELECTRIC SUPPLY MAKES NO OTHER EXPRESS OR IMPLIED WARRANTIES, AND SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. UNDER NO CIRCUMSTANCES, AND IN NO EVENT, SHALL BAYSIDE ELECTRIC SUPPLY BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL, DIRECT, INDIRECT, LIQUIDATED, EXEMPLARY, OR PUNITIVE DAMAGES. BAYSIDE ELECTRIC SUPPLY’S LIABILITY, IN ALL CIRCUMSTANCES, SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE PRODUCT THAT GIVES RISE TO ANY LIABILITY. BAYSIDE ELECTRIC SUPPLY WILL NOT BE RESPONSIBLE FOR LABOR CHARGES OR INSTALLATION FEES OF ANY KIND. If you have purchased a product from Bayside Electric Supply and find it to be defective, notify us immediately at lighting@BaysideSupply.com for assistance in processing your claim.
Orders could take 2 to 3 weeks for delivery depending on availability, custom and made-to-order items often have much longer lead times. Some items on our website may indicate an in stock quantity amount, this is subject to prior sale and only an estimate of the most recent inventory level at the manufacturer’s warehouse (not in our warehouse). Occasionally production schedules change and a product will be temporarily out of stock. This can cause delays. Backorders from manufacturers are beyond our control. Notify us at lighting@BaysideSupply.com if your order has not been received within the time expected and we will track your order as soon as we receive the information. Factory shipment or delivery dates are the best estimates of our suppliers. Bayside Electric Supply and subsidiaries are not to be accountable for any delays in delivery. In no case shall Bayside Electric Supply be liable for any consequential or special damages arising from any delay in shipment or delivery. In addition, all claims for shortages must be made by notifying us at lighting@BaysideSupply.com within (5) days of receiving your order.
Special Ordered Items
All items not normally stocked in Bayside Electric Supply’s local warehouse are considered special ordered items and will require payment in full prior to processing the order. Any orders placed for special ordered items may be refused or cancelled by us, at our sole discretion, due to the manufacturer’s terms and conditions of sale. Special ordered items could also be subject to additional shipping charges, special order processing fees, longer lead times, and may be non-cancellable and non-refundable.
Order Cancellation or Changes
You may cancel or change most non-custom orders if they have not yet shipped. All custom made-to-order items are noncancellable and non-refundable. To submit a cancellation request notify us immediately at lighting@BaysideSupply.com. We will track the status of the order and notify you with a confirmation of cancellation, or a notification that your request could not be successfully processed. Any cancellation fees imposed by the manufacturer will be your responsibility and will be deducted from any refund issued. Bayside Electric Supply reserves the right, at our sole discretion, to refuse or cancel any order and to limit the quantity of any item.
Pricing or Product Discrepancies
Bayside Electric Supply makes every effort to assure the accuracy of pricing and product information on our website and in our local stores. From time to time, pricing or product information may be inaccurate. In such cases, we reserve the right, at our sole discretion, to refuse or cancel the order. In the event of inaccurate product information, our sole responsibility will be to accept the product return and provide a customer refund. Bayside Electric Supply and subsidiaries are not responsible for incorrect colors purchased due to buyer’s computer monitor color resolution. Monitor resolutions vary and may cause differences in the color viewed and the actual color of the product.
Acceptance of Order
Acceptance of any order is subject to credit approval and acceptance of the order by seller and suppliers. If buyer fails to comply with these terms & conditions or if buyer’s credit becomes unsatisfactory to seller, seller reserves the right to terminate upon notice to buyer and without liability to seller.
Bayside Electric Supply and subsidiaries are committed to protecting your privacy. Information you provide us will not be sold or given to any outside party, except to the extent necessary to process your order. Any such information is kept private and confidential.
